Regional Law 25/99

In implementation of the Legge Galli, the Emilia-Romagna Region approved Regional Law 25/99, as modified by Regional Law 1/2003, which:

  • outlines the ATO for adherence by local administrations to the provisions of art. 9 clause 4 of the Legge Galli in the area of SII, and by art. 23 of the Decreto Ronchi in the area of urban waste management;
  • governs the forms of cooperation between local administrations under each OTA for exercising the administrative functions involved in organizing, regulating and supervising public utility services;
  • sets the terms and procedures for organizing public utility services in order to achieve industrial-style management based on the criteria of efficiency, effectiveness and economy, and ensure protection of the environment and territory;
  • describes forms of guarantees for consumers and to ensure the quality of services.

Specifically, Art. 3 of the law states that the provinces and municipalities of each ATO constitute a form of cooperation (agreement or consortium) to solely represent the interests of the associated local administrations and to exercise all administrative functions concerning water and environmental services, to organize and complete the SII as well as the integrated urban waste cycle. The form of cooperation exercises its assigned functions per the provision of Regional Law as Agenzia d'Ambito for public utility services, and is classified as a public company.

Regarding management of the SII, upon activation the Agenzia d'Ambito:

  • identifies the existing managements that may be assigned the protective functions per art. 9 sub-section 4 of the Legge Galli, in compliance with the SII reunification principle;
  • determines how to overcome direct management and other forms that do not meet the criteria of efficiency, effectiveness and economy. Upon comparison of possible management solutions based on technical, economic and entrepreneurial criteria and taking into account the need to overcome management fragmentation, chooses which shall be assigned to the protected management areas or assigned to a new party.

Regional Law 25/99 identified the ATO of the Emilia-Romagna Region for the territory of each Province.
